General Filing Requirements
Patents
In order to obtain a filing date for a patent application (PCT or Paris Convention), the following minimum requirements must be received prior to the filing deadline:
- The name and address of the Applicant(s);
- The name and address of the Inventor(s);
- The Specifications, Claims, and Abstract;
- All priority data and application data.
In a number of jurisdictions, it is possible to file the application in English and within a specified time period, file the corresponding translation into the local language. The remaining documentation may be filed belatedly (see below), and the term varies depending on the particular jurisdiction.

Patents (PCT)
In addition to the minimum requirements listed above, the following information and documentation may also be required:
- A Power of Attorney (a number of jurisdictions require notarization and legalization).
- Simple copies of the US Assignment are usually acceptable in PCT matters (if, in fact, an Assignment is required) and do not require legalization. However, some countries may require an original Assignment (either a local form or a certified copy of the Assignment(s) in the priority case). These documents usually require notarization and/or legalization.
- If applicable, Formal Drawings and their translation.
Patent - Paris Convention
In addition to the minimum requirements listed above, the following information and documentation may also be required:
- A Power of Attorney (a number of jurisdictions require notarization and legalization).
- An Assignment of Inventors; most countries accept a certified copy of the US Assignment filed in the priority application. Depending on the jurisdiction, the document may need to be notarized and/or legalized.
- A certified copy of the Priority Document(s). Some countries also require a translation of the priority application(s).
- If applicable, Formal Drawings and their translation may also need to be filed.
Trademarks
In order to obtain a filing date for a Trademark application, the following minimum requirements must be met:
- The name and address of the Applicant(s);
- The Word Mark or design;
- If the Mark is other than a Word Mark, copies of the proposed Mark will be required; if color is to be claimed, then color copies will need to be submitted at the time the application is filed.
- A description of goods and/or services, together with the International Class, if known.
In addition to the minimum requirements listed above, the following information and documentation is normally required:
- A Power of Attorney (a number of jurisdictions require notarization and legalization).
- In the event that priority is claimed, the Priority Document may need to be furnished.
